Minnesota Lemon Law
Your vehicle is an important investment worth protecting. For most people—except for their home—a car, truck, motor home or recreational vehicle can be the biggest purchase they will
make. YOU DON'T HAVE TO ACCEPT A LEMON! If your vehicle has spent more time in the shop than it should, we can help.
Dan Brennan is a Minnesota Lemon Law attorney focused on
protecting your rights under the Minnesota Lemon Law and the
Magnuson-Moss Warranty Act.
Don't be a face in the crowd! Be wary of Lemon Law
lawyers who want to use your case as grist for their Lemon
Law mill! Too many cases in the hands of any one lawyer may
mean that your interests are not being fully served. Be sure
to ask a prospective attorney whether he or she is located in Minnesota
(some will try to lead you to believe that they are
Minnesota Lemon Law attorneys when, in fact, they are from out-of-state!)
and how many cases they have at any one
time. More does not necessarily mean more for you. At Brennan Law Office, your case will be given the time
and attention it needs and deserves by a highly experienced Lemon Law attorney representing clients with lemon vehicles
and products in Minnesota.
You're not alone. Manufacturers and
dealers are experienced in the art of convincing you that
you don't have any recourse but to accept the problems with
your lemon vehicle and their inability to resolve them. You
need an attorney with the experience to protect you
and level the playing field with these large manufacturers
and their dealerships. Dan Brennan is
a Minnesota Lemon Law attorney experienced in representing clients under the Minnesota Lemon Law and Magnuson-Moss Warranty Act. Prior to representing consumers
in Minnesota Lemon Law matters, Dan represented major automobile, motor home and recreational vehicle manufacturers in
Minnesota, Wisconsin, Magnuson-Moss
Warranty Act and other types of cases. He now represents only consumers
with their claims under the Minnesota Lemon Law. As a
result, Dan is a highly knowledgeable and effective
Minnesota Lemon Law attorney who knows the ins
and outs of what it takes to ensure that you are not stuck with a "lemon."
Is your vehicle a lemon under the Minnesota Lemon
Law? Do all of these statements apply?
- You purchased the vehicle in the State of Minnesota.
- The vehicle was delivered new to the original consumer less than 4 years ago (the repair orders will usually indicate this as the delivery date).
- At least four attempts have been made to repair the same or similar problem or the vehicle has been in the shop for a total of more than 30 business days.
- You use the vehicle at least 40% of the time for personal use.
- You own or lease the vehicle.
If so, your vehicle may be a lemon under the Minnesota
Lemon Law.
What if your vehicle is a lemon? The Minnesota Lemon Law provides that if your vehicle is a lemon the manufacturer must either replace your vehicle with a comparable vehicle or refund
the price you paid for your vehicle, less a reasonable use allowance ($.10/mile not to exceed 10% of the vehicle price). Dan Brennan
is a highly qualified and experienced Minnesota Lemon Law
attorney who has successfully tried and settled hundreds of Minnesota Lemon
Law cases on behalf of his clients.
What will it cost? Under the Minnesota Lemon Law and the Magnuson-Moss Warranty Act, a successful consumer is entitled to recover legal fees and litigation costs from the manufacturer.
We take cases on a contingency basis. That means that we only get paid if you win or settle your case on terms acceptable to you.
Protect your rights! Always be sure to get a copy of the REPAIR ORDER for each repair attempted on your vehicle. If you don't already have them, request duplicates from the
servicing dealership. Also, if you have conversations with the service staff about the problems with your vehicle, make a note and keep it with the repair orders. We will need these documents to fully evaluate your case
under the Minnesota Lemon Law.
Be sure to check out the resource section of our site to see if there are Technical Service Bulletins (TSBs) or Recalls that apply to your vehicle.
These provide valuable support for your Minnesota Lemon Law
case. And don't forget to ask the servicing dealership if there are TSBs for your vehicle. Too often, dealerships withhold this valuable information from you.
